TERMS OF USE

The owner of the website www.barabeku.com (hereinafter referred to as "the website") is SIA "BaraBeku" (hereinafter referred to as "the company"), registration No. 50203373681, legal address Ēdoles iela 27, Kuldīga, Latvia. The content of the website is the property of the company. Any republication or use of the information must be agreed with the company. All rights reserved. The company reserves the right to change the content and terms of use of the website and these shall take effect as soon as they are published. By accessing and using the www.barabeku.com website, the user acknowledges that he/she has read the terms of use and agrees to comply with them.

In order to ensure a convenient and unambiguous shopping experience, we have prepared a distance contract (see below), which sets out our mutual cooperation (distance contract regulated by the Regulation of the Cabinet of Ministers of the Republic of Latvia No 255 "Regulations on Distance Contract" and the "Consumer Rights Protection Law")

1. GENERAL PROVISIONS

 

1.The Seller undertakes to sell and deliver the goods to the Buyer in accordance with the order placed in the online shop.

2.The Seller informs that the product information is subject to change without notice.

3.General description, composition and care information can be found in the product description for each product individually.

4.Product prices are shown separately for each product and are subject to change without notice and discounts may apply. Goods are sold at the prices prevailing at the time of order, except where the Goods are listed at an unreasonable price due to technical error or system failure. 

5.In the event that the Goods ordered are unavailable or there are problems with delivery, the Seller shall notify the Buyer within 1-2 working days. 

6.The colours of the products in real life may differ from those displayed on the internet due to the monitor settings. 

7.Delivery charges (if any) will be accounted for separately before payment is made.

 

2. ORDER PLACEMENT AND PAYMENT

 

8.To place an order in the online shop, the Customer selects the goods, their size or one of the available variations and adds them to the shopping cart. To confirm the order, the Customer selects the option - Add to basket.

9.The Buyer shall check that the products, quantities and prices in the order correspond to his wishes before making payment.

10. To place an order, add the relevant Products to the basket and click the "Order" button.11:

    - by payment of the invoice received by e-mail

    - payment by pre-purchased e-gift card

12. When placing an order, the Buyer receives an invoice with company details and transaction details by e-mail;

13. the invoice is drawn up electronically and is valid without signature;

14. the Buyer pays the invoice by bank transfer or payment card / internet banking;

15. the Buyer must enter the preferred method of collection of the Goods, delivery address and contact details. 

16. the Seller shall only commence production of the Order if the Seller has received the money for the Order in its bank account.17. The Seller shall not be liable for any damages or other consequences arising from incorrect data provided by the Buyer in the order.

 

18. In the event that, after the order has been placed, the Seller is unable to deliver the product ordered or the desired quantity, the Seller shall be entitled, in consultation with the Buyer, to replace the product with an equivalent product.

19. In the event that the Goods cannot be replaced or exchanged, the Buyer shall be entitled to cancel the order and the money will be refunded to the Buyer's bank account within 14 working days.

20.The Seller is entitled to cancel the order by notifying the Buyer and stating the reason for cancellation by e-mail or telephone. In the event that the Seller fails to fulfil the order, the Buyer shall receive a refund within 14 working days.

 

3. DELIVERY OF GOODS 

 

21. The Seller shall deliver the order to the Buyer in accordance with the Buyer's chosen delivery method:

     - by indicating your preferred Omniva parcel (to all Omniva points in Latvia the delivery fee is EUR 3)

     - by indicating your preferred DPD PickUp point (to all DPD PickUp points in Latvia the delivery fee is EUR 3)

     - free collection in Kuldiga, Latvia

     - contact us for EU and WORLDWIDE shipping options and prices. 

22. Upon receipt of payment for the order, the Seller shall manufacture and dispatch the orders within 2-10 working days.

23. In urgent cases, if the Buyer requires faster dispatch/delivery, the Buyer shall inform the Seller in order to agree on the possibility of faster dispatch/delivery.

24.In the event of any delay in the preparation of the order, the Seller shall immediately inform the Buyer of the delay in delivery of the order.

25.If the Buyer wishes to receive the order by another delivery method, the Buyer must agree this with the Seller by email to barabeku.kids@gmail.com or by using another of the methods of contact specified in the "Contact" section.

26. The Seller shall not be liable for any delay in the delivery of the goods caused by a delay in the delivery service (Omniva, DPD, etc.) selected by the Buyer.

4. RIGHT OF WITHDRAWAL

 

27.The Buyer has the right to withdraw from the ordered goods within 14 days of receipt of the order in the following cases:

    - The goods have not been used

    - The goods are packed in the original packaging with the original trademarks and in complete condition

    - The goods are not soiled, creased or otherwise damaged

28.To withdraw from the goods ordered, the Buyer shall fill in the electronic Withdrawal Form. 

29. the costs of returning the Goods due to the Buyer's cancellation shall be borne by the Buyer.

30. The Seller shall refund the price of the goods to the Buyer's bank account within 14 days of receipt of the goods (delivery and return shipping costs are not included in the refund amount)

31. In the event that the Buyer has requested changes to the Goods and they are made to individual order, the Seller shall not accept returns and shall not alter the Goods. (Paragraph 22 of FC 255)

32. By concluding a distance contract, the Buyer is familiar with the right of withdrawal as well as with the conditions for filling in the withdrawal form

33. When exercising the right of withdrawal, please send the goods to the Omniva outlet - Kuldīga Sūru iela RIMI outlet, Sūru iela 2, Kuldīga, indicating the telephone number 29145315 and the company name SIA "BaraBeku" (It is obligatory to fill in the withdrawal form in advance)

5. DATA CONFIDENTIALITY

 

34.We take responsibility that your private information (name, delivery address, etc.) will not be disclosed to third parties, unless requested to do so by law enforcement authorities.

35. The Seller may request the following personal data from you for order processing, accounting purposes and to arrange delivery of products: name, address, telephone number and e-mail.

36. By using the website, the user agrees to the processing of personal data. This is necessary for the placing of an order and the delivery of goods.

37. The Seller may collect and store data that allows the analysis of the website's traffic and use.

38.The data provided by the Customer is stored on the website developer's platform, on the Seller's computer and at the email address barabeku.kids@gmail.com. The data is protected and can only be accessed with a secure password.

39.The Buyer's data shall be stored for a period of 5 years, as required by law. 

40. We respect privacy and will never use your data for any purpose that could limit your privacy;
